INTRODUCTION
The following Terms and Conditions of Trade (T&C’s) govern all work performed by the companies TheRampMan (KERBY.NZ is a website alias) and may be altered at any time by TheRampMan (TRM). Any instructions or requests for services received by the Company from the Customer for the supply of Goods or Services via e-mail, verbally, credit application, purchase order or in writing, are deemed acceptance of Services supplied by the Company and shall constitute acceptance of the current T&C’s herein. This agreement, or engagement, is a commitment to a “Common Sense First” approach formalised and is commonplace within the industry. Please take time to thoroughly read through and ensure you understand these T&C’s before you commence a project with TheRampMan (TRM) or buy the licensed product KERBY™ from TheRampMan (TRM).

TheRampMan (TRM) – Terms & Conditions of Trade
At TheRampMan (TRM), we aim to deliver high-quality, custom aluminium ramps tailored to your unique site conditions. As a hands-on, local Kiwi business, we do our best to balance great service with the reality of installing ramps on a variety of concrete surfaces.
1. Concrete Disclaimer
Please note: Concrete is not an exact science. Driveways may have imperfections such as curves, dips, bumps, or level changes. Every install is different, and we work with what’s physically in front of us at the time.
This means:

A slight gap between ramps may be left to prevent noise or “squeaks”.

Ramp positioning may vary slightly depending on the curb alignment and concrete surface.

Any variation required due to surface irregularities may incur an additional charge (a Variation).
We always strive to make the ramps look and perform their best for your custom site at the time of install.
2. Measurement Responsibility
You are responsible for providing accurate measurements (in mm) for the access width you require. We cut and fabricate ramps to the dimensions you supply when accepting a quote via our web form, email, or phone.

If your ramps are too short, additional 1m extensions can be installed later at an extra cost.

KERBY™ cannot cover drains or sumps.
Incorrect measurements or post-installation changes may incur additional labour or relocation fees.
3. Acceptance of Terms
By engaging our services, requesting a quote, or accepting a final quote via email or web form, you are deemed to have accepted these Terms & Conditions.
4. Intellectual Property
All content, designs, drawings, and ideas are the intellectual property (IP) of TheRampMan (TRM), trading as XDC – XClint Design + Creative Ltd (XDC.NZ).
Do not copy, share, or use any proposals, photos, drawings, or ideas without written consent.
5. Confidentiality Notice
Any correspondence, quotes, drawings, or attachments from us are confidential and privileged. If you are not the intended recipient, please notify us immediately and delete all materials.
6. Visual Representations & Joins
Images on our site may not show the fine details of standard joins. Some gaps are expected, especially on curved installs using standard straight-cut lengths.

Short lengths under 1m may appear tighter but become less stable and noisier over time.

We may glue joints where needed, but this is not guaranteed long-term. Repairs may incur a $50+GST call-out fee.

Ramps performs best in 2.4 or 3m continuous lengths, offering greater stability and load distribution.

Important Information About Your Installation
All Quotes/Estimates indicate the general design and assembly for your ramp installation and are valid for 14 (fourteen) days only due to the volatile nature of raw material pricing (e.g., aluminium and other metal-based components). While every effort is made to ensure accuracy in quoting, it is ultimately your responsibility to carefully check all measurements, pricing, text, and design details prior to installation. TheRampMan (TRM) accepts no liability for minor discrepancies or variations caused by the concrete surface itself—gaps, height differences, and irregularities are a normal part of working with unpredictable concrete and are factored into the install at the time.
Installation Process:
We drill into your concrete using specialised tools and fasteners (such as Stainless Steel Dynabolts, Sleeve Anchors or Concrete Screws) to secure the ramp. Each install is finished with dome caps or covers for a clean look. During the process, we work around any unforeseen variations in your concrete—uneven surfaces, curves, slopes, and bumps—which only become fully visible when placing a straight-edge product on site. These are levelled and stabilised using hidden wedges and other techniques to give you the most durable and aesthetically pleasing result possible.
Need clarity?
If any part of your quote is unclear, please don’t hesitate to ask. Our estimates are carefully prepared—often using Google Maps or a site visit—to determine whether the job is a Straight Install, Slight Curve, or Tight Complex Curve, which affects time, materials and approach.
All quotes are ballpark figures based on current material pricing and our best assessment of your site’s conditions. They are subject to adjustment based on closer inspection at time of install, particularly if we encounter unexpected concrete challenges or site-specific requirements. If any Variation to the original quote is needed, this will be communicated to you verbally or by text, and your agreement (either in writing or verbally) will trigger the update of the quote/invoice to reflect the change.
Payment Terms:

To lock in your booking, full payment is generally required in advance.

Standard payment terms are within 7 days of invoice unless otherwise arranged (NET-7).

A $50+GST surcharge applies to any job where payment is received after the due date.

Interest of 15% p.a. applies to any invoice overdue more than 30 days.

TRM reserves the right to initiate legal recovery action, and all associated costs and interest will be recoverable by TRM in addition to the full invoice amount.
Curved Install Notes:
In curved installations, straight 3m standard lengths generally cover the curve. Sometimes we use pairs of short ramps to cover the slight curve. For tighter curve, a precise measureup is needed and therefor a CAD drawing will be produced to determing the curve and therefor an accurate quote. The benefit, a custom-made curved ramp in one piece that fits the curve like a glove to follow the curve. This involves extra material, cutting, and fixing time. Please consider this when estimating the cost for curved entrances or access points.
TRM installs will always aim to provide the best balance of visual alignment, durability, and load distribution based on your entrance or garage positioning and surrounding surface. The final positioning and angle will be determined on-site for best overall results—subject to your approval where possible.
Final Notes:
If any job needs to be stopped or cancelled, only materials and time used up to that point will be charged. A minimum service fee of $50+GST applies once any work has commenced.

Acceptance
Any instructions received by TheRampMan (TRM) from you, the Client, for the supply of products and services shall constitute acceptance of the Terms and Conditions (T&Cs) contained herein, above and below on this website page. Having accepted our quote by this website submission, by email or by voice (which is an estimate), and after the fact as accepting the installation of our products or services, serves you as deemed to have accepted our T&Cs.
TERMS AND CONDITIONS OF TRADE
TheRampMan (TRM)
By instructing TheRampMan (TRM) to supply any products or services—whether verbally, by email, or via this website—you, the Client, acknowledge and accept the following Terms and Conditions (T&Cs). Acceptance is also deemed to have occurred upon acceptance of our quote or upon installation of our goods or services.
1. DEFINITIONS
1.1 “Seller” refers to TheRampMan (TRM) and includes its successors, assigns, and authorised agents acting on its behalf.
1.2 “Customer” refers to the person or entity requesting or receiving the Seller’s goods or services. This includes any authorised representative acting on their behalf.
1.3 “Guarantor” means any individual or entity that agrees to be liable for the debts of the Customer on a principal debtor basis.
1.4 “Goods” refers to any items supplied by the Seller as defined in Section 2 of the Sale of Goods Act 1908. This includes but is not limited to physical products, concepts, or creative elements.
1.5 “Services” refers to all work performed by the Seller for the Customer, including consultation, advice, recommendations, documentation, installation, or design. Services also include any time spent on work deemed beneficial to the Customer and may extend beyond the duration of a specific contract.
1.6 All Services may include creative ideas, original designs, phrases, and concepts containing Copyright and Intellectual Property (IP) belonging to the Seller. These remain the Seller’s property unless purchased outright or licensed per Clause 15.
1.7 “Price” means the amount payable for Goods or Services, as determined by estimate, quote, or mutual agreement.
1.8 These T&Cs govern all work undertaken by the Seller. They may be updated at any time and are available via this website or by link in any email or invoice.
1.9 Instructions or acceptance of Services by the Customer constitute full acceptance of the current Terms and Conditions of Trade.
1.10 “Portfolio” means the Seller’s right to display completed or in-progress work on their website or marketing materials unless otherwise agreed in writing.
1.11 The Seller reserves the right to retain and use the Customer’s name, contact details, and project outcome for its customer list and marketing, including entry into awards or competitions.
1.12 “Associate” refers to any person or entity defined as an “Associated Person” under the Income Tax Act currently in force.
1.13 “Proof” means a working version of the project provided in either digital or printed format.
1.14 “Final Proof” refers to the version of the project ready for sign-off and deemed “Good to Go,” based on verbal, written, or email confirmation from the Customer.
1.15 “Excess Work” means work requested by the Customer that exceeds or varies from the original estimate, quote, or proposal. Such variations are billable.
2. COMMENCEMENT AND ACCEPTANCE
2.1 Instructions from the Customer for Goods or Services constitute acceptance of these Terms and Conditions.
2.2 If more than one Customer is involved, all parties are jointly and severally liable for payment.
2.3 Acceptance of a quote, estimate, or email—whether verbal, written, or electronic—serves as confirmation of agreement to these Terms and Conditions, which cannot be revoked without written consent from the Seller.
2.4 No agent or representative of the Seller has authority to vary these terms unless explicitly confirmed in writing by the Seller.
2.5 The Customer must provide written or email confirmation before work commences. This serves as a formal agreement between the parties regarding the outlined project.
3. GOODS AND SERVICES
3.1 Goods and Services will be as described in any quote, estimate, invoice, or work authorisation provided by the Seller.
3.2 The Customer agrees that before-and-after photos may be used by the Seller for marketing purposes, including display on the website or in future quotes.
4. PRICE AND PAYMENT
4.1 The Price shall be determined at the Seller’s discretion by one of the following methods:

(a) The amount shown on the Seller’s invoice;

(b) The Seller’s prevailing rate at the time of delivery;

(c) An accepted quote or estimate, valid for 14 days unless stated otherwise;

(d) Time and materials basis (hourly rate x time spent);

(e) Value-based pricing, determined by the benefit delivered to the Customer;
-
(f) Disbursements or third-party costs may be charged in addition;
-
(g) Where multiple Customers are involved, all are jointly liable;
-
(h) Installment payments may be arranged by prior agreement;
-
(i) Standard payment terms are seven (7) days from invoice date, unless otherwise stated;
-
(j) Payment methods include direct credit, cash, or any other method agreed;
-
(k) GST and applicable taxes are additional unless stated otherwise.
4.2 Late Payment:

A $50 + GST late fee applies to overdue invoices.

A default penalty of 15% per annum (calculated daily) applies to any unpaid balance.

If debt collection is required, all associated costs (including legal fees, commissions, and surcharges) will be added to the Customer’s account.
